DPP Fights to Keep Jacque Maribe's Car

Journalist Jacque Maribe will have to spend more time without her car after the ODPP stated that it was not ready to hand over the property to her.

Appearing before Justice James Wakiaga on Thursday, the prosecution led by Senior Assistant Director of Public Prosecution (SADPP) Catherine Mwaniki objected Maribe's application stating that they were not yet through with her house, car and phone.

The prosecution stated that they were still analysing the car adding that Maribe's phone would remain in their custody for fear that she might destroy evidence.

The prosecution explained that only until the items are presented as exhibits in court for Monica Kimani's murder case will they hand it over to her.

Through her lawyer Katwa Kigen, Maribe stated that she needed time to respond to the affidavit by the investigating officer.

Speaking to Kenyans.co.ke, Secretary of Digital Innovations and Diaspora Communications Dennis Itumbi who accompanied Maribe to court revealed that only the car had been withheld as the rest were handed to her.

In a statement filed in court, the prosecution indicated that they had completed analysis at the journalist's home, which was a crime scene, and had even handed back the house to her.

Maribe was charged with the murder of businesswoman Monica Kimani together with her fiancé with the former being granted bail.

Irungu was, however, denied bail with Justice Wakiaga terming him a flight risk with no known primary location.

“The accused has no known assets in the country save for an intention to set up a private security firm and, therefore, I find him to be with no fixed abode, lacking any deep emotional, occupation or economic ties in the country and is likely to abscond should an opportunity arise,” the judge stated.

He stated that Irungu's willingness to surrender his passport was not a guarantee that he would not leave the country. The application will be heard on March 13.
