Manager Demands Ksh300M From City Hospital Which Fired Him

Timothy Odhiambo Otieno, 36, has sued The Nairobi Hospital after he was fired in May 2019.

The former director of ICT in the institution argued before Employment and Labour Relations court judge that his termination was illegal and the management denied him the right of appeal.

Otieno, in his suit, demanded Ksh292,655,000 as general damages and loss of income from July 1 to retirement at 60 years.

He also demanded the be compensated his gross salary in place of his notice amounting to Ksh2,805,000.

Otieno told the court that he demands to be paid his leave to date amounting to Ksh 467,500, service pay for 29 months of service of totaling to Ksh935,000.

He is also demanding payment for the loss of medical cover at an annual premium of Ksh200,000 and mortgage adjustment from Barclays Bank of Kenya amounting to Ksh4,142,738.

The ex-manager claimed that his age and over qualifications would act as a hindrance to him getting new employment.

He noted that the potential employers were scared of his qualification and the salary he would demand on the basis of his experience.

Otieno told the court that he intended to work at the institution for the rest of his adult life and that the hospital should be held liable for making him jobless.

He further argued that trumped-up charges were brought against him, leading to the sacking.

Otieno added that his reputation in the IT community was left in tatters and he was unable to get alternative employment at another firm with equal and or better pay.

Other orders that he sought was to stop the management from filling the position he was fired from or the hospital from restructuring to do away with the position until the determination of the case.

The court certified the matter as urgent and directed him to serve The Nairobi Hospital.
