How Waiguru & Husband Beat Karua at Her Own Game

Kirinyaga Governor, Anne Mumbi, on Wednesday evening, disclosed how she and her husband lawyer, Kamotho Waiganjo, beat an election petition filed by former Minister Martha Karua.

She had appeared on KTN's Pointblank that is hosted by Tony Gachoka.

"This is really what fascinates me about Martha, her being a lawyer, I'm not a lawyer. There was a time limit that was set in law and they (Karua's team) were time-barred," Waiguru spoke.

The high court judge then dismissed the case since time had lapsed but Karua successfully appealed and the court battle was back on.

"She was fully heard and the determination was the same. She did not prove that there was malpractice and therefore the case was thrown out. 

"She went to appeal. During the appeal, and this is the thing she keeps talking about, which I think misleads Kenyans. She says that the Court of Appeal [sic] ruled on the technicality but it didn't. 

"It ruled on the basis of the evidence she provided to show that there had been election malpractice," the county boss explained.

The appelate court also ruled that the case should have been filed within the time set, the same thing the high court had noted.

Their court battle then dragged on to the Supreme Court, which failed to overturn the ruling by the Court of Appeal.

Waiguru also expressed the irony that Karua was among those pushing for election petitions to be filed in a timely fashion, during the formulation of the Constitution of Kenya. 

Speaking about her husband's role in the court battle, the governor was thankful that Waiganjo was part of the team and therefore, the cost wasn't too much to bear. 

"Luckily for me, my legal team didn't quite charge me too much, partly because my husband was also on the panel," she explained.
