Embattled Kiambu Governor, Ferdinand Waititu, has crafted a new plan to help him regain access to his office.
According to The Standard, Waititu has moved to the Court of Appeal to contest the decision to bar him from the county offices.
Waititu, through his lawyer, Tom Ojienda, argued that the High Court was at fault in declaring that he was not allowed to operate from his official work station, following the graft case filed against him by the Director of Public Prosecution, (DPP) Noordin Haji.
Ojienda stated that the orders, requiring Waititu not to step foot in the county's offices, are equal to removing him from the elective post.
He added that the charges against Baba Yao are not among the reasons cited for removal of a governor from office, according to the Constitution of Kenya.
Waititu also challenged the amount of money he was asked to part with to secure his freedom. He protested that a Ksh15 million cash bail or Ksh30 million bond was too much for the offence he was charged with.
The governor wants the appellate court to reduce the cash bail to Ksh2 million or grant bond of Ksh5 million.
In August, Waititu circumvented Justice Lawrence Mugambi's orders barring him from office, by declaring that he will continue running the county from a different location.
He also addressed reports that they was a growing rift between him and Deputy Governor James Nyoro.
"I spoke with the deputy governor a few days ago and he still knows that I am in power. Anajua mimi ndio boss. Mimi ndio mdosi (He knows I am the man in charge of Kiambu), Waititu disclosed.
