A last-minute move to save Nairobi Governor Mike Sonko from impeachment was rolled into play, hours before the Senate decides whether or not to eject him from office.
The Senate will either uphold or reject the motion presented by the County Assembly on Thursday, December 17.
On Wednesday, December 16, 57 Nairobi MCAs filed a lawsuit in court arguing that their accounts were hacked, thereby, indicating that they voted electronically to oust Sonko.
They added that they never voted but were rather enjoying a holiday in Kwale County on December 3.
The lawmakers want the court to overturn the decision by the County Assembly in which 88 MCAs supported Sonko's impeachment.
They also asked the judge to quash any decision that will be made by the Senate plenary on Thursday, December 17.
"The County Assembly has purported that the 57 MCAs voted for the motion to impeach the Governor.
"It is impossible that they would have attended the debate whether physically or virtually as they were away in Kwale," their lawyer Eliakim Owalo stated.
Owalo added that the 57 MCAs were not consulted and that the entire impeachment process was illegal.
On Wednesday, December 16, MCAs who ousted Sonko defended their case before the Senate. They accused Sonko of squandering taxpayer money to the tune of Ksh 4.6 million on his daughter's trip to the US in 2018.
They alleged that Nairobi County's first daughter embarked on the trip disguised as a county administrator, to purportedly attend the County First Lady's conference held during the 62nd session of the Commission for the Status of Women 2018.
Other allegations labelled against Sonko include gross misconduct, violation of the constitution and abuse of office.
