A Chinese restaurant was ordered to pay a Kenyan youth Ksh3.07 million after one of its employees was filmed whipping the local citizen

The video was shared widely in February 2020 when the incident occurred, sparking nationwide uproar and condemnation. 

The Employment and Labour Relations Court ruled the Chinese restaurant located in Kileleshwa, Nairobi illegally dismissed the Kenyan, identified as SOS, whose rights were violated. 

It was also ascertained that the local was sexually harassed by the Chinese employee. Evidence tabled before the court alleged that the Kenyan was assaulted for declining to give in to the boss' sexual advances.

SOS worked at the restaurant for three months before he was allegedly fired without compensation. 

"The petitioner was, in addition, cajoled to engage in an affair with the second respondent and was threatened verbally, abused and given corporal punishment upon resisting the advances," the judge ruled. 

He added that SOS was humiliated, subjected to cruelty, psychological trauma, pain and suffering owing to the sexual harassment and assault. 

Interior CS Fred Matiang'i deported the three Chinese who were accused of infringing the rights of the Kenyan.  

Speaking to Kenyans.co.ke on Saturday, July 10, SOS urged all employees, local and foreigners to respect their staff and the rule of law. 

"This case had stalled in court and I am happy that my lawyer revived it and I was rewarded. 

"Receiving the money will prove to be a tall order and I urged CS Fred Matiang'i to ensure the foreigners return to Kenya to account for their mistake," the victim stated.

He added that his lawyers would take a certain percentage of the money as attorney fees.
