Interior Cabinet Secretary Fred Matiang'i has threatened to sue former State House digital strategist Dennis Itumbi over social media posts he made linking the CS to the Ruaraka land scandal.

In a letter dated Wednesday, August 11, by V.A. Nyamodi & Co Advocates, acting on behalf of Matiang'i accused Itumbi of publishing a series of highly defamatory tweets.

The CS instructed Itumbi to immediately retract the tweets he made by Friday, August 13, and thereafter send an apology via his official twitter account.

Failure to heed to demands by the Interior boss will institute legal proceedings against Itumbi.

"Consequently, we are instructed to demand as we hereby do, your immediate and unreserved retraction of all tweets referring to our client as a thief, an unconditional apology to our client, and that you immediately expunge the defamatory statements from your Twitter account. Our client further demands an unconditional apology for the defamatory statements published via your verified Twitter account in a manner approved by our client," the letter read in part.

The letter added, "take notice that if you do not comply with the terms of this demand by close of business Friday, 13 August 2021, our client shall institute legal proceedings against you without any further reference to you and your sole liability for all attendant costs and consequences."

Speaking to Kenyans.co.ke, Itumbi confirmed receiving the letter and stated that he would send a response to the same on Thursday, August 12.

Itumbi sued Matiang’i over the Ruaraka land scam. He filed the case as a private prosecution and made an application on a certificate of urgency in November 2020.

The digital strategist was seeking to prosecute Matiang’i over the irregular acquisition of land belonging to Ruaraka Primary School when he was the Education CS.

He wanted Interior CS prosecuted on four counts of abuse of office and corruption-related charges.

In November 2018, the Senate shot down a report recommending investigations and prosecution of Matiang’i, Education PS Dr. Belio Kipsang, and top National Land Commission (NLC) officials over the controversial Ksh.1.5 billion Ruaraka land compensation to businessman Francis Mburu.
