New details have emerged on the demise of two Kianjokoma brothers who lost their lives while in police custody in Embu County.
The six officers who were arrested and charged with the demise of brothers, Benson Njiru Ndwiga, 22, and Emmanuel Mutura Ndwiga,19, now say that they have a witness who saw what happened on the night the two lost their lives.
According to the police officers who worked at the Manyatta Police Station in Embu, a "single witness who was seated at the back of the Land Cruiser saw the brothers jumping out".
But what remains a puzzle is how the witness in question was the only person who supposedly saw Njiru and Mutura jump out of the vehicle, yet initial reports have it that there were ten people in the same Land Cruiser.
Notably, autopsy results on the two showed that they passed on as a result of multiple injuries, which could have been caused by blunt force trauma.
Court documents revealed that three of the officers sat at the back with several suspects who had been picked.
Evidence that had been collected also includes a sketch of the sitting arrangement in the police land cruiser carrying Njiru and Mutura and eight other detainees.
Three police officers were also seated at the back of the vehicle, according to the court papers.
Their lawyer, Danstan Omari pleaded with the court to grant the six police officers lenient bail terms, arguing that they can not interfere with investigations.
Omari further told the court that Independent Policing Oversight Authority (IPOA) had completed its investigations into the matter as he asked the court to grant his clients bail.
They accused Director of Public Prosecutions Noordin Haji and IPOA of yielding to public pressure and resolving to charge them with the henious crime and ignored material evidence.
Omari also argued that the DPP ignored segments of the constitution that grant for an inquest when a person passes on in police custody.
The court stated that the bail application will be heard on September 22, 2021.
