A Courtroom was filled with laughter after a Pakistani national questioned why he should not be granted bail which the prosecutor had argued for.
The foreigner stated that the prosecution lacked credible reasons for denying him bail while Embakasi East Member of Parliament, Babu Owino, was given cash bail for what he claimed was a more serious offence.
The court burst into laughter after the Pakistani lamented that Babu Owino was allowed to settle his case with entertainer Felix Orinda, popularly known as DJ Evolve, out of court.
Appearing before Senior Principal Magistrate R.K Ondieki, the Pakistani who was charged with obtaining goods worth Ksh10 million unlawfully stated that his case did not warrant being denied bail.
The suspect was charged with allegedly obtaining 2165 bags of diapers valued at Ksh4.8 million.
According to the charge sheet, the suspect was also accused of obtaining 1900 pieces of water dispensers and strands valued at Ksh5.5 million.
He pleaded for leniency and argued that he was not a flight risk since he is married to a Kenyan.
However, the prosecution through state prosecutor Patience Bange, objected to his release on bail stating that the accused had three passports and could leave the country at will.
His bail application was scheduled for February 22, 2022.
The accused referred to Babu Owino's attempted murder charges that were dropped on Tuesday, December 14, 2021. The first time legislator had been accused of injuring DJ Evolve in a scuffle at an exclusive club in Nairobi.
Babu was alleged to have shot the DJ who has been recuperating ever since the incident occurred in early 2020.
After the charges were dropped, the lawmaker spoke to Kenyans.co.ke, stating that he was grateful to God for seeing him through the period. He further maintained that his family was close to that of the DJ, but declined to divulge any intricate details about their deal.
"There are a lot of things we agreed on medical and compensation of physical things. We agreed in the spirit of forgiveness. DJ Evolve's family is my family and mine is his. DJ Evolve is my brother forever," stated the lawmaker.
Babu was said to have offered to clear Orinda's Ksh17 million hospital bill and pay his nursing costs. He also reportedly agreed to buy the family a vehicle, clear in advance their two-year rent, water, electricity, internet and medicine expenses.
He would also build the family a house and construct another for the DJ in Utawala area, Nairobi.
The court, however, maintained that the MP will be arraigned on the second count of behaving disorderly while carrying a firearm.
