Matiang'i: What Miguna Needs to do to Come Back to Kenya

Interior Cabinet Secretary Fred Matiang'i has detailed how exiled Kenyan lawyer Miguna Miguna can regain his citizenship and travel back to the country. 

In a TV interview on Sunday, April 17, Matiang'i noted that Miguna needed to complete a one-page document as prescribed in the new constitution on the process of regaining one's citizenship, which applies to everybody.

The CS added that Miguna had lost his citizenship by virtue of the old constitution which prevented Kenyans from being citizens of more than one country.

Matiang'i further addressed accusations of his Ministry disregarding court orders as had been claimed by a section of political leaders, noting that he was bound by the law when carrying out his duties. 

"There are two court rulings on how you can regain it after you lost it in the previous constitution as you were barred from having dual citizenship. When the new constitution was enacted, the process was prescribed in the act on how you can regain it. 

"You have to fill a certain form or piece of paper so that you regain your citizenship back as it were. Since that time over 300,000 Kenyans have regained their citizenship. It's as simple as filling a one-page document," the CS told NTV. 

He also posed a question wondering why Miguna had not followed the due process as outlined in the country's supreme law to regain his Kenyan passport. 

"We have opened immigration offices across the world even in Canada. Ask yourself this question, what is so difficult in filling that one-piece of paper?" he posed. 

The outspoken lawyer's attempts to return to Kenya have hit turbulence a number of times after being deported on February 6, 2018, following the swearing-in of ODM leader Raila Odinga, the then NASA chief, as the People's President at Uhuru Park, Nairobi.

 After successfully filing a petition which saw the High Court declare the move as illegal and unconstitutional, Miguna attempted to return to the country on March 26, 2018 but his efforts were curtailed after he was denied entry upon landing at JKIA. 

 He made his second attempt in January 2020, whereby he was denied boarding rights to travel to Kenya upon reaching Germany. This was after a red alert was issued by the government. 

In November 2021, his much-touted return to the country didn't materialize after he stated that the government had issued a red alert over his entry to the country.
