Political parties submitted their list of nominees to the Independent Boundaries and Electoral Committee (IEBC) chairperson, Wafula Chebukati, for approval ahead of the August 9 polls.

The majority of the individuals nominated to seats in the National Assembly and the Senate were loyalties who lost in the primaries.

IEBC's formula to clear the nominees for office is based on those who appear on top of the list shared.

According to IEBC, names are forwarded based on the hope that a political party or a coalition would win the majority of seats in Parliament.

In the National Assembly, the maximum number of nomination slots available is 12. In the Senate, the maximum number is 20;

16 are women, 2 represent the youth and the remaining two are for persons with disabilities.

The maximum 12 slots are shared out among the parties represented in Parliament based on the number of MPs that they have.

If party X for example has 200 MPs in Parliament, the number is divided by the total number of elected MPs (337), then multiply it by 12 - the maximum number of nomination slots.

The formular would likely affect candidates from either political faction or a coalition because IEBC is guided by top candidates in the list.

"For purposes of Article 177(1)(b) of the Constitution, the Commission shall draw from the list under subsection (1) (e), such number of special seat members in the order given by the party, necessary to ensure that no more than two-thirds of the membership of the assembly are of the same gender.

"The Commission shall draw from the list under subsection (1) (f) four special seat members in the order given by the party," reads Section 36 (7) of the Elections Act reads.
