Nine officers from the General Service Unit (GSU) filed a case against the Directorate of Public Prosecution (DPP) and the Independent Police Oversight Authority (IPOA) at the Milimani Law Courts for falsely being arrested.
According to the officers, the two institutions led their arrest for allegedly being involved in a shooting at Masimba along Mombasa Road on June 2, 2022.
According to the court documents, the officers were held up in traffic at Masimba when commotion ensued, and several officers and residents were injured.
The officers stated that they only fired in the air to scare the irate locals who had barricaded the road with stones.
Notably, the officers were transporting money from Mombasa to Nairobi before they were confronted by the rioters, who reportedly had crude weapons, including bows and arrows.
"The mob who had staged a demonstration on the Mombasa highway, protesting violently while heavily armed because elephants were destroying their farming and livestock," read part of the court documents.
After calm was restored, they rushed to the hospital before proceeding to the police station to file a report. Days later, it was reported that the officers had killed four people.
However, on November 4, they were summoned to the IPOA headquarters.
Additionally, their fingerprints were taken, but they were not informed of the reason for the procedure. They were placed in the cells at the Kibra Police station at midday.
"We were initially arrested without reasons being made known to us," read part of the court documents.
They noted that there are reliable resources that indicated that the DPP has already recommended they be charged.
In the court documents, the nine have issued a list of demands noting that being outnumbered by the mob, they acted to the best of their ability in a bid to prevent more innocent casualties.
"A declaration and finding that the applicants had no involvement and/or premeditation of the incidents that happened at Masimba on June 2, 2022.
"To bring into the High Court for the purpose of quashing the decision to charge the applicants with the offense of murder/grievous Harm," demanded the officers.
