Man Steals Machine Gun Stand, Land Cruiser Door Inside Embakasi Military Barracks

A youth was charged with theft after pleading guilty to stealing a general-purpose machine gun mounting stand from Embakasi Garrison in Nairobi.

MacDonald Wanjohi was on Thursday, November 10, arraigned before a Makadara Law Court, where he confessed to stealing the equipment. 

Wanjohi also admitted to stealing a Land Cruiser door belonging to the Kenya Defence Forces (KDF) two days earlier, on Tuesday, November 8.

The two items were valued at Ksh56,000.

The accused was arraigned according to Section 268 and Section 275 of the Penal Code.

"A person who fraudulently and without claim of right takes anything capable of being stolen, or fraudulently converts to the use of any person, other than the general or special owner thereof, any property, is said to steal that thing or property," Section 268 reads. 

Section 275 further provides that anyone convicted of the offence is liable to imprisonment for three years without the option of a fine. 

Before the theft charges were preferred on him, Wanjohi was to be charged with an alternative count of handling stolen property contrary to Section 322 (2) of the Penal Code.

However, these charges were dropped after he admitted to theft before Principal Magistrate Hellen Okwany.

KDF soldiers reportedly apprehended Wanjohi after a commotion at the garrison. The suspect was reportedly caught red-handed stealing the items. 

He was then escorted to the Embakasi police station together with the exhibits, where a statement was filed. 

The case will be mentioned on November 15.
