Why Ex-KBC Boss Wants CS Owalo Jailed

Former Kenya Broadcasting Corporation (KBC) Managing Director, Naim Bilal, wants ICT Cabinet Secretary, Eliud Owalo, committed to civil jail.

In a notice filed in court on Friday, November 25, Bilal alleged that CS Owalo ignored directives on his reinstatement.

He further claimed that the CS failed to implement an order on his reappointment despite being served with court papers.

According to the former KBC Managing Director, Owalo, who committed to transforming the state broadcaster, was served with the court order on November 8.

"Eliud Owalo, Cabinet Secretary or his successor to committed to civil jail for disobedience of court orders issued on October 31," his suit read in part.

"On November 8, the ICT CS and the head of Public Service Commission (PSC) were served with the decree. ICT CS has refused and or declined to obey court orders," Bilal added.

Defending his bid to have Owalo committed to civil jail, Bilal insisted that the court established that his dismissal was unprocedural.

Responding to Bilal, Owalo stated that the government had challenged the verdict at the Court of Appeal.

"Government has, however, filed an appeal before the Court of Appeal to challenge the judgement issued in favour of Bilal.  The matter is, accordingly, alive before the court," Owalo stated while dismissing claims of ignoring court orders.

The culmination of the row between Owalo and Bilal followed a directive issued by the Employment and Labour Relations Court which directed PSC to renew his contract.

Further, the court permanently restrained the ICT ministry, head of public service or the Attorney General from recruiting any other person into the managing director position at KBC.

According to the ruling, the former ICT CS Joe Mucheru violated Bilal's right by failing to renew his contract, yet he had met all requirements.

Instead, Samuel Maina was appointed as the new Managing Director for KBC

"The respondents are hereby restrained by way of a permanent injunction from recruiting any other person for the position of managing director, KBC," the Employment and Labour Relations Court stated.

Bilal was first appointed as KBC MD in 2019. Previously, he was the director of information at the ICT ministry and senior editor at Nation Media Group.
