Pangani police officer Ahmed Rashid was on Monday, April 17, charged with murder relating to the killing of two boys in Eastleigh in 2018.
Rashid, who was accused of killing Jamal Mohamed and Dahir Kheri, was found psychologically fit to stand trial after undergoing a medical examination.
The accused pleaded not guilty to both charges before High Court Judge Diana Mochache.
Rashid's defence team led by renowned lawyer Danstan Omari, however, negotiated for their client to be released on bail instead of being placed in custody at Industrial Area.
Omari argued that by virtue of being an officer and the nature of the crime he was accused of, being placed on remand in the facility posed a danger to his life.
The Advocate assured the court that Rashid would not skip court or tamper with evidence and requested he is released on a Ksh100,000 cash bail.
The judge, however, settled on Ksh200,000 as bail explaining that at the time, the officer was out on police bond and he did not act in any manner to interfere with the case.
Earlier, Justice Mochache dismissed a petition by Omari in which he questioned her jurisdiction to hear the case which had just been handed over to her by a colleague after transfer.
In December, Omari maintained that his client was innocent and maintained that Rashid would not self-incriminate.
He further challenged the prosecution to prove beyond any reasonable doubt that his client was the plain-clothed officer captured shooting the two teenagers in the viral video.
The counsel then tasked the state to justify that the bullets that killed Mohamed and Kheri were fired from his client's firearm, and whether it was murder or manslaughter.
In a sworn affidavit, Rashid maintained his innocence arguing that he had never used his firearm other than within the permitted parameters of the National Police Service Act.
