Senior Principal Magistrate Bernard Ochoi on Tuesday, April 18, ruled that Embakasi East Member of Parliament Babu Owino had a case to answer over misuse of a firearm.
In a ruling that was delivered at Milimani High Court, Ochoi ordered that Babu be put to his defence for behaving disorderly while carrying a firearm.
“After evaluating prosecution evidence and all the exhibits including CCTV footage, l find that the prosecution has proved a prima facie case against the accused person.
"I, therefore, find him with a case to answer and accordingly place him on his defence,” Ochoi ruled.

Babu will have to defend himself, and could face up to five years in jail if found to have violated Firearms Act (Cap114).
The Prosecution accused Babu of misusing his firearm when he allegedly shot and injured Felix Orinda, popularly known as DJ Evolve at B Club in Kilimani area on January 17, 2020.
Senior Principal Magistrate Ochoi ordered Babu to take a stand on June 15, 2023, when he will take a plea of guilty or not guilty.
Ochoi made the decision after listening to over 10 witnesses that were lined up by the Prosecution in order to prove the case against the MP.
Principally, the evidence that was adduced by the Director of Public Prosecutions (DPP) did place Babu, licensed a gun holder, at the scene where he allegedly misused the same while at B Club located along Galana road in Nairobi.
As of 2022, the National Police Service noted that over 8,000 civilians had been registered as licensed gun holders.
The Central Firearms Bureau of the NPS also revealed that some 32 people had their certificates revoked for misuse and unsafe keeping, resulting in theft and accessibility to other hands.
The Bureau also revealed that hundreds others were under investigation for various incidences including public exposure of guns.
