A foreign investor filed a case at the Milimani Commercial Courts in Nairobi on Thursday, April 20, seeking to recover Ksh300 million allegedly swindled from his company's bank account.
In his criminal suit, the foreign investor indicated that he lost the money on various dates, accusing three employees of engineering the heist.
According to his lawyers, the three employees allegedly colluded with a local financial institution to swindle him the money.
His legal team further told the court that different accounts were used in the scheme to hide the identity of the suspects.
Besides colluding with a bank, the foreign investor alleged that a local politician received over Ksh100 million. The balance was allegedly shared between his three employees and bank staff.
"It appeared that the rest of the funds were distributed to various companies on the same day," his lawyer told the court.
Following the revelation, he sued the financial institution for abetting the crime. He reprimanded the financial institution insisting that it authorised the transaction without his approval.
To expedite the hearing, his lawyers appealed to the Milimani Commercial Court to consolidate the cases.
The judge, however, directed all the parties to appear in court on Monday, May 8, for further direction.
During the hearing, the accused persons are set to respond to the charges levelled against them by the foreign investor. The bank must also table transaction receipts to support or debunk the foreigner's allegations.
However, the project the foreigner was working on was not immediately established before losing Ksh300 million in his company's bank account.
