A warrant of arrest was on Friday, May 12, issued against Lamu West Member of Parliament Stanley Muthama over an outstanding debt of Ksh2.2 million.
The deputy registrar of the High Court instructed police stations in Lamu County to arrest the MP for failing to clear his debt.
Police officers based at Parliament buildings were also asked to help effect his arrest.
According to court documents, the debt was incurred after a supply of hardware goods to a company owned by the lawmaker.
It is reported that the aggrieved business entity supplied the goods to the MP, elected on a Jubilee Party ticket, between 2014 and 2015.
“Whereas the sum remains unpaid in respect of the said decree, these orders are to command you to arrest the said Mr Muthama and unless they shall pay to you the sum of Kshs2,277,469 together with executing officer’s fees, if any, to bring the said judgment-debtor before the court with all convenient speed,” read the warrant in part.
It was reported that the goods were initially estimated to be Ksh9 million with the legislator clearing Ksh6.7 million.
The warrant of arrest was issued after the aggrieved business entity pleaded with the court to have the MP arrested for failing to honour a payment schedule that had been agreed upon.
“Kindly but urgently issue warrants of arrest against Hon Stanley Muthama for being a serial defaulter, owing to the balance of a sum of Ksh2,277,469.20 that has fallen due.
“As per the decree of October 14, 2022, under Clause (V) in default of any single installment the entire balance falls due and warrants of arrest to issue against the 2nd Defendant, Hon. Stanley Muthama,” the plaintiff's lawyer Robinson Kigen asked the court.
In earlier court documents, the legislator had indicated his struggles in settling the arrears.
Muthama indicated that his business faced numerous financial challenges in 2019 which led to its closure.
