Jubilee Party Deputy Organising Secretary Pauline Njoroge has been set free unconditionally.

Speaking to Kenyans.co.ke, her lawyer Soyinka Lempaa noted that the narcotics charge she had been apprehended on did not feature on the charge sheet.

"There was no bail. She has been released freely because the application that was made by the prosecution was very hopeless and could not stand the test of anything. So she had been discharged.

"(The narcotics claim) was hot air because the charge sheet that we were able to see, that claim was not there. There is no holding charge," stated Soyinka.

Njoroge was taken in on Saturday after police officers claimed that they found four rolls of dry plant material believed to be narcotics.

The officers attached to Watamu Police Station later claimed that they escorted her to her rented room at Mawe Zuri Resort and found a clear container containing ten (10) tablets believed to be narcotic substances.

Soon after, she was taken into police custody and produced in a Malindi court on the afternoon of Monday, July 24.

A charge sheet seen by Kenyans.co.ke showed that Njoroge was taken into custody over a series of tweets including one where she criticised an alleged operation the police carried out in Nyanza arguing that it was point-blank brutality.

Her detention, however, unsettled some players within the ruling party including Digital Strategist Dennis Itumbi who disagreed with the charges leveled against her.

In his argument, the former Chief Administrative Secretary (CAS) nominee noted that all Kenyans were allowed to make mistakes in their social media posts.

As a result, he challenged the Office of the Director of Public Prosecutions (ODPP) to drop the charges and set her free.

"Publishing on mainstream and on Social Media includes the right to make mistakes, to get it wrong. That is why Media houses carry apologies on their pages after getting it wrong. It is okay in the business of publishing to get it wrong.

"On social media, fake news cannot be cured by (taking anyone in). The best way is to fact-check them and state the right position. Importantly, it has been upheld across civilisation that even the right to insult is part of free speech. On this one, with utmost respect to the office of the DPP, I disagree," stated Itumbi.

"Free Pauline Njoroge and if you can drop these charges (do it). I chose silence till I saw the charge sheet!" He added.
