25-year-old Kelvin Waruguru from Kirinyaga County never imagined spending the rest of his life in jail after a night out with friends.

The young man while speaking on Njeraini Citu show, revealed that he did not complete college but was operating a successful business selling second-hand shoes on top of running other establishments.

However, fast forward, he is now serving a death sentence at the Nyeri King'ong'o Maximum Prison.

"This place is tough, it needs you to have a thick skin. While in prison, your body is not the only thing jailed but also the mind," Waruguru remarked.

While narrating his story, Waruguru explained that he was living in a two-bedroom apartment where one of his friends would come to spend the night on several occasions.

His girlfriend was in the US and had just landed in Kenya and Waruguru organised a party for her birthday. The group of friends and family were at a local joint drinking the night away until around 2 am when some got tired.

According to Waruguru, his friend asked if his girlfriend could spend the night at the house but the convict refused. He explained that it was inappropriate since his girlfriend was in town, and asked the couple to look for another option.

This marked the end of Waruguru's freedom as he was later accused of beating up his friend while the lady was assaulted and abused.

Waruguru explained that the following day, he was ambushed by police officers, including an OCS who had accompanied the very friend he had denied a place to sleep.

As captured in his narration, the friend told the police that he had stolen from and assaulted him the night before. His girlfriend would also tell the police that she was raped near Waruguru's home.

He would then be arrested alongside a second suspect. The two were taken to the local police station as investigations commenced.

"I was told that I beat up the guy and stole his phone and Ksh1,700. However, I did not leave the house and he found me in the house, he did not even have the things he claims I stole," Waruguru noted.

Waruguru's friend told the police that he heard the convict's voice while he was being mugged and therefore implicated him in the crime. The lady also identified one of the suspects who allegedly raped her.

Waruguru would later be charged with robbery with violence while the second suspect was charged with rape.

He was detained at the police station for over 14 days before he was released on bond. Waruguru noted that the complainant's parents wanted to withdraw the case but the prosecutor rejected his proposal.

Before the hearing began, the convict travelled to Mombasa for work and failed to show up in court. This led to a judge issuing a warrant of arrest for him.

Waruguru, as he continues to serve his sentence, urged the youth to keep off activities that may land them in jail.

Notably according to Section 296 (2) of the Penal Code anyone found guilty of robbery with violence is liable to a death sentence.
