High Court Orders 2 Businessmen To Surrender 11 Cars in Asset Recovery

Two businessmen have been ordered to surrender eleven vehicles and four parcels of land to the government following a ruling by the Milimani Law Courts.

According to a Gazette Notice published on April 19, 2024, the case was filed under the Anti-Corruption And Economic Crimes Division on June 12 2013 by the Assets Recovery Agency.

The vehicles include a KAZ 1**M Prime Mover, KCC 2**R DBA-ACA33W Van Guard, KCT 1**M CR-V, S. Wagon, KAE 0**A CWC Lorry/Truck, KCV 4**T Legacy Wagon.

Others are a  KCQ 8**X Axor Prime Mover, a KBQ 4**Y CBE-NCP51V S. Wagon,KCL 444U Prime Mover 2543, a KCP 6**F Actross 2448 Prime Mover,ZF 6**3 Doll Trailer, and a ZF 8**0 Trailer-Skeleton.

Deputy Registrar, High Court of Kenya, Anti-Corruption & Economic Crimes Division Adelaide Sisenda further directed the two respondents to surrender four parcels of land implicated in the case, as proceeds of crime. 

The named parcels are located in the Mwembelegeza area in Mombasa, the second, third and fourth pieces are located within the Mombasa Municipality. 

“This Honourable court be pleased to issue an order that all that income accruing from the developments on the land parcels of the land parcels listed in prayer 1 above be forfeited to the Assets Recovery Agency (the Applicant herein),” the Gazette notice reads in part. 

The court further directed the Director of the National Transport and Safety Authority to effect the directive and submit the implicated motor vehicles to the Assets Recovery Agency. 

“They do make any other ancillary orders it considers appropriate to facilitate the transfer of the property forfeited to the Government,” the Gazette added.

In a different case published in the same Gazette, a businesswoman implicated in a money laundering scheme was ordered to surrender Ksh1.3 million to the government, as proceeds of crimes committed through her company. 

Further, two financial institutions were linked to a case involving a businessman in a money laundering scheme. According to court orders, the respondent is to forfeit two cars of the Nissan Note model. 

"This declaration hereby issues that the following motor vehicles are proceeds of crime and therefore liable for forfeiture to the Government of Kenya: KDJ 0**Z, Nissan Note and KDD 8**L Nissan Note."
