Missed Calls Land Husband in Jail

A woman in Meru County wants her husband to be imprisoned for allegedly sending her abusive text messages over failing to answer his phone calls.

Speaking before Meru Chief Magistrate Evans Makori, Ms Lydia Nkatha urged the court to sentence her husband, Moses Muriungi, to prison after he admitted that he insulted her.

“I am his wife but he has disturbed me for a long time. Two years ago, he burnt all my clothes. He would send me abusive text messages whenever I refused to pick his phone call. That is why I want him jailed,” said Ms Nkatha.

The Magistrate, however, attempted to convince the woman to settle the matter out of court as they had been married for 20 years and had sired 2 children.

Ms Nkatha remained adamant and further refused to file a divorce suit despite persistence from the Magistrate.

“It would be prudent for you to file a divorce suit in this court rather than having your husband whom you had been living with for 20 years jailed,” said the Magistrate.

During the mitigation process, the defendant told the court that he was the family's breadwinner hence his children would not be educated if he was jailed.

Mr Muriungi said that he had begged for forgiveness from his wife over the incidents, but she instead reported the matter to Giaki Police Station.

He insisted that his wife may be cheating on him as she had a tendency of not picking his calls. Mr Muriungi will be remanded till December 1 when a probation report will be presented in Court.
