Senator Wetangula Survives IEBC Axe

Bungoma Senator Moses Wetangula has been saved from being struck off the voters register, a consequence that would have seen him lose his Senatorial seat.

The Independent Electoral and Boundaries Commission (IEBC) on Tuesday, cleared Senator Wetangula of voter bribery claims.

The electoral commision ruled that there was no sufficient evidence to link the Senator to the alleged election offence as he was not convicted by any court of the same.

"The IEBC found no proof and justification to delete Wetangula's name from the voters register," said Commissioner Mohammed Alawi.

The Senate Minority leader also survived being rendered ineligible to vie for any political seat in the next elections.

According to the Special Committee that listened to the allegations, deleting the Senator's name would infringe on his constitutional rights, given that the alleged electoral malpractice had not been proven beyond reasonable doubt.

The Commissioners went ahead to poke holes on the Election Act which provided provision for the deletion, claiming that it lacked clarity.

This follows gazetting of a ruling by the the High Court and upheld by Supreme Court, which found the Minority leader guilty of election offenses in the run-up to the March 4, 2013 General Election.
