VIDEO: How Sh200 Million Kidero, Tunoi 'Bribe' was Exchanged

The tribunal investigating bribery allegations against suspended Supreme Court Judge Philip Tunoi, on Wednesday visited the Petro Fuel Station at Waiyaki Way where it is claimed Tunoi received a Sh200 Million bribe from Nairobi Governor Evans Kidero.

The Sharad Rao-led probe team alongside its legal advisor Paul Nyamodi and Tunoi’s lead counsel Fred Ngatia visited the scene to reenact the events of the fateful day, to determine the truthfulness of claims made by Tunoi’s accuser, journalist Geoffrey Kiplagat.

Kiplagat who claims he was the middleman between Tunoi and Kidero explained what took place as the scene was reenacted.

First, a mercedes and a prado, which are the car models Kiplagat claims were used, were parked alongside each other and a man in the tribunal’s security detail moved the money bag weighted down with 20kgs worth of newspapers, from the front passenger side door of the Prado to the open driver’s side door of the Mercedes.

Tunoi then accused Kiplagat of giving conflicting accounts as he had earlier said in an interview that the money was passed through the windows.

The recreation was repeated this time passing the money through the car windows which was unsuccessful at first because the bag fell between the two cars but was successful when the cars were moved closer.

According to Kiplagat, the whole exercise took three minutes but in the replication, it took only 30 seconds to pass the money across, hence casting doubt on Kiplagat's allegations.

Justice Tunoi is said to have received the bribe in order to rule in favour of Kidero in an election petition that was filed by the now Kabete MP Ferdinand Waititu, challenging the election of Governor Kidero.

Kiplagat filed an affidavit in which he narrated how in May 2014, he was allegedly contacted by prominent Nairobi businessman Mike Njeru who asked him to be a go between in the exchange of the money.
