Watchman Awarded Sh1.7 Million

An Employment and Labour Relations court in Nakuru awarded a watchman Sh1.7 Million as compensation in an unlawful termination of employment suit.

Jared Odhiambo Ojao had claimed that Poly Pipes Ltd sent him home on July 1, 2014 through word of mouth.

“I reported to work as usual but the employer told me that my services were no longer required," Ojao told the court.

The plaintiff also told the court that he was dismissed without a letter and had not committed any offence.

Although Poly Pipes Ltd did not deny the accusations, Judge Stephen Radido went ahead and ruled that Mr Ojao be awarded Sh1,388,640 in overtime dues and underpayments of Sh58, 573, among other payments that sumed up to Sh1.7 Million.

Justice Radido ruled that the Employment Law required an employer to give at least 28 days written notice of employment termination and be paid by the month. The Judge decided the case saying that Ojao's sacking did not follow the procedures provided by law.
