Chief Justice David Maraga on Wednesday responded to questions touching on Deputy Chief Justice Philomena Mwilu's case.
Speaking to journalists at the Supreme Court after swearing in commissioners of the National Gender and Equality Commission, Maraga stated that the Judiciary would expedite the case facing the DCJ.
The CJ admitted that he had received a brief from the Director of Public Prosecutions Noordin Haji of the planned arrest.
Efforts by journalists to get him to speak on the case did not yield more information as Maraga remained tight-lipped on the matter.
"Leave it at that! Leave it at that! I don't want to comment on matters that are in court," he told the media before retreating to his chambers.
He, however, acknowledged that DCJ was and would remain the Judiciary’s Chief Ombudsman, a position she had held since she was appointed to the current position.

Mwilu was arrested on Tuesday afternoon and later arraigned in court to face four criminal charges.
On Wednesday, accompanied by her 32-lawyer team, Justice Mwilu filed a case at the High Court to have the prosecution halted.
The orders sought were granted by Justice Chacha Mwita in the afternoon.
Judge Mwita stated that the petition raised constitutional issues that needed to be addressed adding that the charges Mwilu faced arose out of a commercial dispute.
He maintained that the court needed to determine whether a commercial dispute can amount to a criminal charge.
The High Court Judge further directed that the matter be heard on October 9.
