ANC Expels Kakamega Senator Malala

Update: Tuesday, July 7: The Registrar of Political Parties declines to execute a request by Amani National Congress (ANC) to expel him from the party arguing that the request for the expulsion was turned down due to procedural gaps.

The Registrar stated that the disciplinary proceedings were not concluded within the stipulated timelines under Article 49 of the ANC Party Constitution  and that the National Governing Council did not approve the Disciplinary Committee as reconstituted by the NEC in line with Article 46 (1)(d)(ii) of the ANC Party constitution.


Update: Friday, June 26: Senator Cleophas Malala has reiterated that he is still in office as Kakamega Senator.

"As I was presiding over the proposed impeachment of Governor Anne Waiguru, some people were hiding in some cocoon planning to remove me from the party (ANC)," Malala hit back while presenting Kirinyaga Governor Anne Waiguru's impeachment report in Senate on Friday, June 26. 


Amani National Congress (ANC) has expelled Kakamega Senator Cleophas Malala after the party's governing council met on Friday, June 26 and ratified the decision.

The meeting was attended by all ANC MPs and its Governing Council at Amani National Congress party headquarters in Lavington Oloyangalani drive, Nairobi

ANC argued that Malala had disrespected the party leader Musalia Mudavadi. ANC had warned Malala of expulsion after he campaigned for ODM's Imran Okoth in the November 2019 Kibra by-elections.

The party, later on, summoned him for a disciplinary committee which Malala declined to honour.

"Your utterances, and activities at the political rally convened by the Orange Democratic Movement (ODM) at Kibra on October 27, 2019, prejudiced the integrity and reputation of the ANC Party, its members, and employees,” the committee ruled.

Malala had also recognised Raila Odinga as his legitimate leader instead of Musalia Mudavadi while claiming that ANC planned to give his seat to former Kakamega Senator Boni Khalwale in a by-election that would be conducted later on. 

Malala added that campaign for Okoth was similar to Musalia Mudavadi campaigning for Raila Odinga in 2017 presidential elections.

In the meeting, ANC also resolved to postpone its National Elections due to Covid-19, therefore, extending the tenure of current officeholders. 

The Registrar of Political Parties Anne Nderitu had ordered Amani National Congress (ANC) to organise election after the terms of office bearers ended. 

“In light of the above, kindly avail information on timelines and notification of the ANC elections in line with Articles 18, 22 and 26 of the ANC constitution," Nderitu had stated in a letter addressed to ANC Secretary-General Barrack Muluka. 

The party further announced that it had ratified its constitution.
