DCI Probe Missing Evidence in Linturi Case

The Directorate of Criminal Investigation (DCI) has launched investigations into the mysterious disappearance of crucial evidence in a case against Meru Senator Mithika Linturi.

In an affidavit submitted before the Milimani Law Courts by Robert Keith, the officer in charge of the case, it was revealed that photos and videos stored in a phone had been deleted.

The officer stated that their discovery was unusual adding that they would unravel what happened.

He alleged that the destruction of the evidence was suspicious adding that their investigations will confirm their concerns.

Keith further disclosed that they had begun forensic analysis of the phone in a bid to retrieve the destroyed evidence for the case to proceed.

“We are conducting further investigations into an offence of destroying evidence as per section 116 of the penal code in respect to nude photographs and nudes videos which I have reasons to believe the accused person herein played a key role in their deletion.

  

“The retrieval is ongoing and we shall provide further nude photos and videos as they become available,” he stated.

On September 14, 2021, the senator was presented before the Milimani Court and charged with attempted rape that was alleged to have happened at a hotel in Laikipia county.

This was after a 36-year-old woman reported the matter to the police.

“Charged with attempted rape, contrary to section 4 of the Sexual Offenses Act of 2006,” 

“On January 30, 2021, at around 3 am at Maiyan Villas Hotel, Nanyuki in Laikipia East Sub-County in the Republic of Kenya, the accused intentionally touched the woman without her consent,” read the charge sheet read.

In an earlier appearance before the court, the senator demanded that the police release money that was confiscated by the police. It was alleged that the senator made the payments to the lady to have the matter settled out of court.

"Your honour, I am making an application to have the prosecution release Ksh200,000 which is in their possession for the last year. The said money belongs to my client and was recovered from the complainant by the police,” lawyer Muthomi Thiankolu, Linturi's lawyer told the court.
