Blogger Ndiang'ui Kinyagia has sought the court's protection, alleging that his life is in danger.
Appearing before the Milimani Court on Thursday July 24, the blogger requested that the court protect him from arrest by the police, so that he can proceed with the affidavit.
"Your honour, I would like to request that the court offer me protection from arrest so that I can have an opportunity to review this affidavit with our advocates Kibe Mungai and Wahome Thuku," the blogger said.
The court had previously ordered that the blogger should not be arrested, an order Ndiang'ui wanted the court to extend.
"Plea to this court is to extend the orders that you had given that I not be arrested by the police. I seek your protection because I fear for my life and my arrest," the blogger continued.
Justice Chacha Mwita of the High Court granted Ndiang'ui 14 days to file an affidavit explaining his disappearance on June 21.
LSK, Karua Withdraw
Meanwhile, the Law Society of Kenya and Senior Council Martha Karua sought to withdraw from representing the IT expert who was accused by the DCI of self-abduction.
When questioned by Justice Mwita if he had any advocates, Ndiang'ui clarified that he was being represented by Kibe Mungai and Wahome Thuku, leaving out LSK and Karua, who were on the frontline of the case during its onset.
Ndiang'ui brought the country into tension after he vanished from his home in Kinoo, leaving behind his gadgets and going completely off-grid on June 21.
His family and the LSK suspected an enforced disappearance, citing a raid by suspected DCI officers who seized his devices without a court order.
The High Court then ordered the Inspector General of Police and DCI Director Mohamed Amin to produce him or explain his whereabouts. On July 3, he resurfaced at Milimani Law Courts, saying he had gone into hiding fearing for his life.
The next hearing is scheduled for September 16, where the court expects a full account from Ndiang’ui himself.
