Duale Orders Clinical Officers to Negotiate New CBA Amidst Strike

Health Cabinet Secretary Aden Duale has directed striking clinical officers to comply with new government instructions, a move that has drawn criticism from the medics, who claim the CS is frustrating efforts to resolve the ongoing strike.

Duale, on Wednesday, January 7, ordered the union to negotiate a fully inclusive Collective Bargaining Agreement (CBA), arguing that the current CBA only applies to a limited group of clinicians under the Ministry.

He alleged that the current CBA, which needs his signature, only covers 150 clinical officers directly employed by the national government, leaving out more than 7000 clinicians employed by county governments, those in referral hospitals, and even thousands more.

“Let us all agree so that we sign one collective agreement in one meeting. The document I have, which I can even sign tomorrow, is for only 150 clinicians working for the Ministry of health,” Duale stated.

However, he faulted the union leadership, dismissing them as populist, and called on clinicians to organise fresh elections to install leaders he said would better champion their interests.

His demands come even as the clinicians accuse the CS of being the barrier to ending the strike that has been ongoing for over 16 days, despite approval from the salaries and remuneration commission (SRC).

The clinicians maintained that the collective bargaining agreement is complete and pending the Health CS’s endorsement, noting that counties sign separate CBAs for their staff. Duale, however, has dismissed claims that a standalone ministry CBA can be signed.

“The county governments and referral facilities legally do their own CBAs. The SRC has approved the CBA for clinical officers, he is the only one standing on the way,” the clinicians claimed.

The Kenya Union of Clinical Officers (KUCO) announced a nationwide strike on December 22, 2025. The strike has since continued disrupting services in public health facilities across the country.

KUCO demands the signing and implementation of the CBA that they claim was finalised in August 2025. They also demand recognition under the social health authority (SHA).

The clinicians also demand salary and allowance increments as advised by SRC, as well as payment of outstanding arrears owed to them. 

The Council of Governors (CoG) attempted to seek court orders to stop the strike, but the court declined to issue restraining orders; therefore, the strike is legal.

Duale has now stated that he will not sign the CBA until terms are revised to accommodate all members rather than a select group. 

Attempts to end the strike by the Ministry of Labour failed as the Ministry of Health and CoG were unable to attend a meeting on December 23, 2025.
