A judge who was presiding over the case of ODM Party's National Elections Board Chair Judith Pareno surprisingly set her free after finding her guilty of contempt of court.
Justice Jessie Lesiit chose to reprimand Ms Pareno instead of punishing her for disobeying the court.
"You are holding a high office which is respected in the country, and being a woman and a mother, it is your responsibility to bring members of the party together, not to scatter them," Justice Lesit stated
She added, "It is my responsibility to reprimand you and that I have done. I hereby lift the warrant and set you free."
Last week, the High Court ordered the arrest of Ms Pareno after she failed to appear in court to clarify why action should not be taken against her for disobeying orders in regards to the disputed ODM nominations for Muhoroni Constituency.
The party had declared the incumbent, James Onyango K'oyoo, as the winner prompting his rival Professor Ayiecho Olueny to move to court challenging the results.
In his petition, Ayiecho complained that he did not know the source of results which were used to declare K'oyoo winner. The court then directed Pareno to ensure that results were tabulated and the winner declared using the totals, an order which the party did not follow through.
Lesiit observed that Pareno stage-managed the process yet it was her duty to ensure the nominations were free and fair.
