Government Demands Arrest of Raila and Kalonzo

Director of Public Prosecutions, Keriako Tobiko, has ordered for the investigation, arrest, and prosecution of NASA leaders Kalonzo Musyoka and Raila Odinga.

In a letter addressed to the Directorate of Criminal Investigations Ndegwa Muhoro, the DPP is asking that the two NASA principals be investigated for uttering and repeating statements to effect that there will be no presidential elections on October 26, 2017.

Odinga and the Wiper leader are accused of being in breach of the elections act. The two are also being accused of breaching the penal code in harassing and intimidating IEBC officers.

The DCI boss has now been directed to undertake thorough, comprehensive and fast investigations into the allegations.

Muhoro has further been ordered to complete and submit the results of the probe within twenty-one days for the DPP to give further directions.

“I have called on the DCI to undertake thorough comprehensive and expeditious investigations.

“I have also designated a team of senior prosecutors to provide technical guidance and assistance to investigating teams,” he added.

The DPP's response comes following a letter written by lawyer Harrison Kinyanjui on behalf of voters who requested that a probe be conducted against the NASA princials.

The advocate contended that the alleged statements and utterances of Odinga and Kalonzo amount to criminal offenses under the Penal Code and the Elections Act.

The two principals have also been accused of contempt of the order issued by the Supreme Court of Kenya for fresh Presidential Elections in Petition No. 1 of 2017.
