David Maraga Invites Uhuru to Supreme Court

Chief Justice David Maraga has invited President Uhuru Kenyatta to the Supreme Court to attend the annual presentation of the State of the Judiciary and the Administration of Justice Report (SOJAR).

President Kenyatta is expected to attend the event on Friday morning at the SCOK grounds in what will be his first time to step foot on the premises since he became the Head of State.

The President will be the chief guest at the occasion and is expected to formally launch the judiciary report to the public.

Section 5 (2) (b) of the Judicial Service Act, 2011, requires the Chief Justice to give an annual report to the nation on the State of the Judiciary and the Administration of Justice.

Further, Section 38 (4) requires the Judiciary to gazette and send a copy of the report to each of the two Clerks of the two Houses of Parliament for it to be placed before the respective Houses for debate and adoption.

The initiative is aimed at fostering accountability of the judiciary and encouraging public participation in its dealings.

On Thursday CJ Maraga led the Supreme Court bench in making a decision on the controversial death sentence punishment which is part of Kenya's Penal Code.

The highest court in the land determined that death sentence is unconstitutional as it violates the dignity, access to justice and right to fair trial for the suspects charged in court.

The judges further observed that the sentence that is mandatory for certain violations of the law hinders the presiding judges from exercising their best judgement of some cases that may not merit a death sentence.

The apex court had been petitioned by two death row convicts Francis Karioko and Wilson Thirimbu to overturn the sentence imposed on them by the High Court.

President Kenyatta will be meeting CJ Maraga for the first time since the swearing-in ceremony that took place at the Kasarani Stadium on November 28.
