NASA's Action if Chiloba and His Team Are Not Charged

National Super Alliance (NASA) Chief Executive Officer (CEO) Norman Magaya on Tuesday announced the Opposition's plan if top Independent Electoral and Boundaries Commission (IEBC) officials, including CEO Ezra Chiloba, will not be charged for bungling the August polls.

Mr Magaya indicated that the Raila Odinga-led team would initiate private prosecutions beginning this month arguing that the coalition would not let the cases go because they are part of their electoral justice reforms.

Mr Magaya accused the Director of Public Prosecution (DPP) Keriako Tobiko of sabotaging the prosecution of the electoral officials which was launched in September last year.

“The DPP ordered investigations be done within 21 days. Those 21 days expired a long time ago, demonstrating that Tobiko was engaging in public relations theatrics.

“We planned that if no action is taken, we will undertake private prosecutions this year. These are cases we will pick up from this January. We already have charges, evidence and everything are lined up. We will move swiftly,” he stated in an interview with The Star.

A joint team of investigators from the Ethics and Anti Corruption Commission (EACC) and Directorate of Criminal Investigations (DCI) is yet to submit the report to the DPP three months since the probing began.

Nonetheless, Beatrice Omari, senior communications officer in the DPP's office stated that Mr Tobiko had not received any response from EACC and DCI regarding the requested files.

The probing was launched last year when the DPP directed the joint team to investigate 11 senior electoral officials within three weeks and submit the files by October 23.

EACC boss Archbishop Eliud Wabukala, on his part, stated that he was not aware of the status of the investigations of Mr Chiloba and his team.
