Duale's Fate in Parliament to be Decided in February

The Court hearing former National Assembly Deputy Speaker Farah Maalim's petition challenging the election of Majority Leader Aden Duale as the Garissa Township MP, will give the final ruling on February 27.

The date was set after all parties in the petition concluded their submissions regarding the matter.

Maalim's team concluded their arguments by submitting that the election was not done according to the law whereas Duale's team noted that the poll was above board.

“The election was free and fair and done in accordance with the Constitution,” Duale's team submitted.

Last year, Mr Maalim, through his lawyer Chahilu Edwin, filed the petition seeking to overturn Duale's win on grounds that the poll was marred by irregularities.

In his petition, Mr Maalim claimed that Duale's supporters were allowed to vote more than twice.

He further alleged that the IEBC officials did not mark the voters with indelible ink after they were presented with ID cards during voting.

"This was a violation of the election laws, there were long delays deliberately created to discourage my supporters," Maalim stated in his petition.

He wants the court to declare that Duale and IEBC jointly committed election irregularities and, therefore, nullify the Garissa Township election.
