Court Drama as Miguna Refuses to Take Plea

There were some theatrics at the Kajiado Law Courts where Lawyer Miguna Miguna was arraigned after he refused to take a plea.

On Tuesday morning the self-declared NRM general maintained he had to be presented before Justice Luka Kimaru at Milimani Law Courts.

Miguna was arraigned in Kajiado despite Judge Kimaru ordering on Monday he be presented at the Milimani Law Courts on Tuesday morning.

The prosecutor charged Miguna with being present and consenting to the administration of an oath to commit a capital offense namely treason contrary to Section 59 (a) of the penal code.

However, his lawyers dismissed the charge sheet, stating that it was defective.

Miguna was charged with 3 counts; among them "administration of an oath to Raila Amollo Odinga and purporting to bind Raila Amollo Odinga to commit a capital offense of treason".

He was also charged with engaging in an organised criminal activity, contrary to the provisions of the prevention of organised crime act of 2010.

“On February 1, 2018 at Okoa Kenya offices Lavington in Nairobi County, professed to be a member of National Resistance Movement (NRM), a group declared an organised criminal group,” the charge sheet read in part.

His lawyers urged the court to direct the Kajiado magistrate to release their client and his file to the Milimani court.

Miguna left the Kajiado law courts without taking a plea.
