High Court Bars Martha Karua From Testifying in Retrial of Kirinyaga Election Petition

The High Court on Thursday issued orders barring former gubernatorial candidate Martha Karua from testifying in a matter connected to her election petition against Kirinyaga Governor Anne Waiguru.

Judge Lucy Gitari barred Ms Karua from testifying on the findings of an audit carried out on the materials used for the Kirinyaga governor poll.

Justice Gitari noted that the report was yet to be tabled before the court so far into the retrial of the election petition.

Ms Karua took the stand to testify at the trial on Tuesday where she indicted Deputy President William Ruto's security personnel on claims of rigging and voter bribery.

"At Kang'aru Primary School I found a Jubilee official being driven around in a police vehicle while dishing out money to voters. I asked the OCPD why he had surrendered his authority to a civilian and why the party official had not been arrested.

"I reported the incident to Deputy Inspector-General of Police Ben Kitili and to the county police commander," she testified.

The former Justice and Constitutional Affairs minister has also taken on Governor Waiguru's lawyers in the courtroom demanding to be addressed as a learned petitioner.

"Even though I am the petitioner, I am also a trained and practising lawyer hence IEBC and Waiguru's lawyers should accord her me the respect I deserve," she stated.

Ms Karua is seeking to have Governor Waiguru's win nullified on what she cites as massive irregularities and illegalities.

The petition was thrown out at first after the same Judge found that it was "hopeless, defective and incurable".
