Martha Karua Files Appeal After Losing Election Petition

Narc-Kenya Leader Martha Karua has moved back to court after she lost her petition challenging the election of Kirinyaga Governor Anne Waiguru in the August 8 elections.

Ms Karua filed an appeal after Kerugoya High Court Judge Lucy Gitari dismissed her petition terming it incurable, defective and hopeless.

"The former Gichugu MP's case is 'hopeless, defective and incurable'," Justice Gitari noted while delivering the ruling.

In her new application at the Court registry in Nyeri, the Narc Kenya leader stated that the ruling by the high court judge was biased in addition to applying double standards.

Through her lawyer Gitobu Imanyara, Ms Karua stated that the Judge used immoderate language in her ruling adding that she (Justice Gitari) included irrelevant matters to the case.

She further faulted the judge for ordering her to pay Sh10 Million to all the respondents in the case adding that that the directive was punitive since the case was determined in the pre-trial.

The respondents who had been listed in the petition include; Governor Waiguru, her Deputy Peter Ndambiri, the IEBC, and county Returning officer Samuel Seki.

Additionally, in the Memorandum of Appeal, Mr Imanyara explained that the judge did not examine the results of electoral materials scrutiny to entirety.

“The results of the scrutiny were available to her and thereby occasioned great prejudice to the petitioner.

“The judge failed by not finding that the petition raised weighty issues of law for investigations and determination by the court in accordance with the constitution and other applicable laws,” he explained.
