Machakos Govenor Alfred Mutua Loses Case to Ex-Wife Josephine Thitu

Machakos Governor Alfred Mutua has lost a case to his ex-wife Josephine Thitu where he sought to divide property worth millions of shillings acquired during his first marriage.

High court Judge William Musyoka dismissed the suit filed by Dr Mutua stating that the issues raised in the case had already been settled in a separate suit.

To add salt to injury, the high court judge ordered the Machakos governor to pay for the cost of the suit.

“A court cannot try the issues raised in this cause without having to determine the same points of law that were conclusively settled by the court in HCJSC No 45 of 2014. Consequently, I shall uphold the objection and strike out the suit herein, with costs to the defendant,” Justice Musyoka declared.

Governor Mutua and Ms Thitu got married in July 2000 and separated in August 2015 citing irreconcilable differences. 

According to the court records their divorce was settled in Australia.

Shortly after being elected governor, Mutua unveiled a younger Lilian Ng'ang'as the first lady, bringing his failed first marriage to the public.

At the centre of the dispute was a multi-million estate and three children.

Thitu told the court that the Governor transferred the plots in Mavoko town, Iveti Hills, Kamulu in the outskirts of Nairobi, a plot in Malili and three others in Simisi/Ilamba in Kitui to her two of which she was holding in trust of her children.

“The rest of the assets were retained by the plaintiff. The court has no jurisdiction to entertain the suit as the property was divided upon the breakdown of the parties’ marriage,” she stated.
