High Court Rules on Garissa University Attack Suspects

Four Garissa University terror attack suspects have a case to answer, the court ruled on Tuesday at the Milimani Law Courts.

The four suspects, Rashid Mberesero, Sahal Diriy Hussein, Hassan Edin Hasan and Muhamed Abdi Abikar are facing charges of a terrorist act, conspiracy to commit a terrorist act and being members of a terrorist group.

The fifth suspect, Osman Abdi Dagane, a watchman at the institution, was acquitted after the court found no evidence linking him to the attack.

He had been arrested on claims that he colluded with perpetrators of the attack by taking photos at the scene and had been in communication with the terrorists.

Magistrate Francis Andayi ruled that the person who claimed to have seen him taking photos was never brought to court.

Also, there was no evidence showing he communicated to the terrorists and photos he allegedly took were never produced in court.

The five had denied a total of 156 counts following the April 2, 2015 attack that claimed the lives of 148 people, a majority being students.

The magistrate ruled that the prosecution had established a prima facie case against four of the accused persons.

The ruling comes almost four years after heavily armed attackers stormed Garissa University and shot innocent students while holding others hostage.

The University was closed down for eight months and opened in January 2016 after extensive renovation but only a few students reported while others were transferred to Moi University.
