A man who was facing a jail term for allegedly raping a woman has Facebook to thank after his chats vindicated him and compelled the magistrate to set him free.
According to a report by The Star, Timothy Syengo Mutua had been accused of raping his best friend Phylis Kasyoka in Imenti North, Meru County last year.
After analysing Facebook chats between the complainant and the accused, however, the judge concluded that the two were lovers and subsequently set Mutua free.
Meru Chief Magistrate Lucy Ambasi further stated that Mutua was framed and that the evidence that was provided did not sufficiently link him to the crime.
Mutua celebrated the ruling revealing that he was happy since he was finally free although the trial had wasted his time, money and derailed his goals.
"I think I will forgive her, I was so stressed during the trial. It is upon the police and the court to do whatever they think is rightful to the complainant. I thank God I'm free from the framed case," he stated.
Kasyoka had narrated to the court that while she had gone to the shop to buy milk, she heard a man call her and then ask her if he could charge his phone at her house.
The man then gave her a drink that made her pass out. She woke up at 4am the next day and did not have her clothes on.
In his defence, Mutua argued that he had known the girl and were dating since high school. They even had plans to marry afterward and had not had sex by the time the charges were filed.
Mutua had been given a bond of Ksh100,000 or a cash bail of Ksh50,000 which was later reduced to Ksh5,000 because of positive probation. He was staring at six months jail term.
