Court Bars Matiang'i From Interfering With These Businesses

The Interior Ministry, headed by CS Fred Matiang’i, has been barred from raiding, closing or interfering with bar businesses in Kirinyaga County.

KBC reported that on Wednesday, High Court Judge Lucy Gitari stated that an application filed by the bar owners association challenging the power of the police and Interior Ministry in the management of liquor business in the country, raises weighty matters which needs to be ventilated.

The judge pointed out that it’s clear the rights of the applicants have been violated by the respondents.

She also issued conservatory orders restraining Interior PS Karanja Kibicho or his agents from arresting and closing bars in the county until the matter is heard and determined.

According to bar owners’ lawyer, Ndegwa Njiru, their application also challenges the power of the police and by extension, the Interior Ministry, in the management of alcoholic drinks since the function is devolved.

Ndegwa also pushed for the high court to declare the Mututho law null and void saying it’s inconsistent with the supreme law.

The lawyer asserted that they will serve the PS, Attorney General Kihara Kariuki, Inspector General Hillary Mutyambai, and Governor Anne Waiguru.

Ndegwa warned that whoever will disobey the order will be cited for contempt.

The advocate further rallied his clients not to be intimidated and not to allow police in their premises until the matter in court is heard and determined.

The case will be heard on July 24.
