Nandi Senator Released on Bail

Update: Nandi Senator Samson Cherargei was released on Ksh300, 000 cash bail or Ksh500, 000 bond after being arraigned at the Milimani Law Courts over hate speech. 

The senator had been arrested by detectives from the Directorate of Criminal Investigations (DCI).

According to the statement by the DCI, on Tuesday, December 3, the senator was nabbed over hateful remarks he allegedly made. 

"Nandi Senator Samson Kiprotich Cherargei has been arrested by DCI detectives following his hateful utterances at Kilibwoni Primary School on 17th August 2019.

"The suspect will be taken to court today (December 3) to face charges of ethnic contempt," added the statement. 

He was believed to have violated Section 62 (1) of the National Cohesion and Integration Act and Incitement to Violence contrary to Section 96 (a) of the Penal Code.

In August 2019, the senator was arrested at his Eldoret home over alleged incitement remarks he made against critics of DP Ruto.

In a video that went viral, Cherargei had called for the profiling of people who were talking ill of the deputy president.

The senator was recorded declaring that any threats to Deputy President William Ruto's 2022 presidential bid would be dealt with accordingly.

"Muendelee kutusi DP lakini mjue we are marking you and we are profiling you, ikifika wakati, tutawashughulikia (Keep on insulting the deputy president but just know that as part of his loyal supporters, we are marking and profiling all his detractors and at the opportune time, we will deal with all of you). 

This was viewed as highly inflammatory, thereby explaining DCI's move to arrest the senator

"Wale watu wanaendelea kupiga vita naibu wa rais, we are profiling you. If you fight the DP you are fighting us, usifikiri deputy hana watu wake, sisi watu wake tuko hapa (Those of you who keep slating DP Ruto just know that we are jotting down each of your profiles. Don't be fooled into thinking that the DP doesn't have his own footsoldiers, we are right here," he added.
