Kabogo Loses Ksh100M Land Grabbing Case

Former Kiambu Governor, William Kabogo, suffered a major setback after the Court of Appeal dismissed his case over ownership of a seven-acre parcel of land in Nairobi's Westlands area.

In a report published by the Daily Nation, on Wednesday, December 11, the appellate court upheld the High Court's decision that directed Kabogo to pay Ksh100 million to Nayan Patel in an alleged land grabbing case.

The three Court of Appeal judges, William Ouko, Fatuma Sichale and Kantai ole Sankale argued that through his company Caroget Investments Ltd, Kabogo colluded with officials to acquire the land illegally. 

The Standard further reported that the land was estimated to be worth Ksh3.5 billion in the case that was heard on December 6, 2019. 

Patel, the owner of Aster Holdings Ltd, through his lawyer, had sued Kabogo's company and listed the then City Council of Nairobi, then Commissioner of Lands, Attorney General and registrar of titles as respondents. 

"The invasion was unlawful and the taking of possession of a privately-owned property amounted to trespass.

"The 1st respondent's (Aster) efforts to get assistance from the police was futile, compelling it to institute an action for trespass," court papers rea.

Kabogo had appealed the case, insisting that he had applied to the defunct City Council of Nairobi in 2007 and was duly allocated the land on a 99-year lease.

He then disclosed that he attempted to sell the land to White Horse Investments Limited for Ksh100 million but did not succeed after he was informed that its title was obtained irregularly.
