Embattled Kiambu Governor Ferdinand Waititu, is set to learn of his fate after the Senate made an announcement on Monday, January 6, 2020.
According to a report published by Citizen Digital, the Senate is set to hold a special seating on January 21, where Waititu's impeachment will be top on the agenda.
Senate Majority Leader Kipchumba Murkomen announced to the press that since the impeachment occurred during recess, there was no legal backing to recall the House to deliberate the issue.
"The House has been notified that we shall have a special sitting on 21st this month to consider the impeachment of the Kiambu Governor,” the Elgeyo Marakwet senator disclosed.
In a statement seen by Kenyans.co.ke, Waititu through lawyer Mwangi Ndegwa stated that his ouster was unprocedural.
“For the reason that the (total) number of the MCAs is 92, thus the statutory quorum required under Section 33 (2) of the County Governments Act to pass such a special motion is 62 members. However, the members' attendance was 57,” reads an excerpt from the statement.
Sixty three MCAs reportedly voted in support of the impeachment motion tabled by Ndenderu MCA Solomon Kinuthia who, among other issues, accused the embattled county boss of gross misconduct and abuse of office.
In the petition, the governor was also accused of recruiting over 600 casuals illegally by sidelining the County Public Service Board.
They further accused him of contravening the public Procurement and Disposal Act by allegedly influencing the award of lucrative tenders to companies associated with his immediate family and close relatives.
However, his close supporters including the Kiambu Sports CEC, Karungo wa Thangwa, came out to strongly support the governor, claiming that the entire impeachment process was rigged from the very beginning.
"The speaker falsified the information. Only 57 were in the house at the time they were impeaching the governor. Three MCAs were in Dubai, 30 were in Nakuru and one was chased out of the house," the CEC stated.
