A CCTV footage shared in court to shed light on the death of the daughter of the Deputy Inspector General of Police, Edward Mbugua.
Police Constable Peter Ndirangu, from the Central Police Station in Nairobi, took the court through CCTV footage of the scene of the accident which occurred in June 2021.
PC Ndirangu showed the Milimani Senior Principal Magistrate, Esther Kimilu, how Nelly Waithera and the suspect, were at the same location during the accident.
Further, the officer narrated how the 25-year-old was squeezed between two matatus that were parked at the junction of Tom Mboya Street and Murang’a Lane in Nairobi.
The Police Constable told the court that the driver, who has since denied the crime, caused Waithera's death. Ndirangu opined that Waithera was killed because of reckless driving along Tom Mboya.
Notably, PC Ndirangu also produced other documents in court which he intended to use and collaborate the CCTV footage and issue an in-depth analysis on the incident.
The officer noted that the driver was reversing at the wrong time without caring about other road users.
“The City Shuttle bus driver is seen reversing the public service vehicle without due care,” PC Ndirangu stated as the court watched the CCTV footage of the Central Business District.
“The victim of the accident was sandwiched between the two PSV vehicles KBR 065B (driven by Mr Magu) and KBL 744L, which was stationary,” the Police Constable testified.
“The suspect reversed the motor vehicle dangerously without due care for other road users and sandwiched a pedestrian, namely Nelly Waithera, between (the bus) another motor vehicle.”
Notably, the police officer faulted the driver over the death of the young lady, pointing out he fled after he realized she had been badly injured.
The court heard that the 25-year-old died as she was being rushed to the Kenyatta National Hospital (KNH).
