Relief for Waiguru in Battle for Ksh 200M Kitisuru Mansion

Kirinyaga Governor Anne Waiguru received a major boost in her quest to defend her Kahigo residence in Kitisuru after one of the proprietors, James Gethenji, identified her as the legal owner. 

Gethenji, the ex-Tetu MP, applied to be included in the case involving Waiguru and a city-based lawyer.

The former lawmaker, through his lawyer, indicated that he sought to be part of the case to aid the court in making a fair decision.

In the ongoing legal tussle for the homeownership, the city lawyer claimed ownership of the same house and disclosed that he sold the house to Waiguru in September 2015.

“It is fundamental that the court allows the proposed interested party (James Ndung’u Gethenji) to be enjoined in the case for the benefit of all involved and for the ends of justice to be met,” Gethenji's lawyer stated.

Gethenji also accused his fellow Kihingo Village estate directors, Gitahi Gethenji and Bob Gethenji, of trying to defeat justice in supporting Kabiro’s claims.



Waiguru sued the developer, Kihingo Village (Waridi Gardens), demanding that her title be issued.

In response to the suit, the developer counter-sued to evict her for alleged non-payment of Ksh266 million in rent since 2015.

The city lawyer, who claimed to be the house owner, stated that Waiguru bought the house when there was a court order restraining Kihigo Village (Waridi Gardens) Limited from selling the house nor mortgaging it, pending the determination of a case he had filed at the high court.

He had successfully petitioned the court to block Kihingo Village Limited from selling the Kitisuru property at the time it was sold to Waiguru.

The court order barring Kihingo Village Limited from selling the Kitisuru property was issued by Justice Erick Ogola on December 5, 2012, and confirmed on December 5, 2013.

Kihingo Village Limited was barred from selling, alienating, transferring, charging, or tampering with the property.
