A waitress at a popular club in Thika has a case to answer in relation to the murder of the former Juja Member of Parliament, George Thuo.

The court heard that the waitress was part of a team that planned the murder of the former lawmaker on the night of November 17, 2013.

Justice Roseline Langat-Korir, on Wednesday, January 25, ruled that the waitress had a case to answer after 30 witnesses and ten exhibits implicated her in the murder case.

According to court documents and witness statements, the suspect served the former legislator an unknown drink on that fateful day.

Another female reveller had bought the drink at the club whose relationship with the former lawmaker was not immediately established.

To prove the charges levelled against the waitress, an affidavit filed by homicide detectives revealed that Thuo's death was due to acute haemorrhagic gastroenteritis due to suspected chemical poisoning.

"I have considered the prosecution case and l'm satisfied that accused persons have a case to answer and each is placed on their defence," ruled judge Korir.

The witnesses in the case included a pathologist who conducted forensic analysis on Thuo's body in South Africa and his widow.

The private pathologist corroborated a report presented by the then-government pathologist, who confirmed the lawmaker was poisoned.

Judge Korir further ruled that five other suspects had a case to answer in relation to the murder of Thuo.

However, the waitress and the other five accused persons will start defending themselves on February 14.

According to the defence team, the accused will give sworn evidence.

The case began on January 14, 2014, when the suspects were arraigned. They all denied the charges setting the stage for a legal battle.
