Githu Muigai Responds to Claims of Abandoning Ruto in ICC Case

Attorney General Prof. Githu Muigai has brushed off claims that the government is not giving enough attention to the case against Deputy President William Ruto at the International Criminal Court.

The AG firmly stated that Mr Ruto's case was receiving as much attention as that given to President Uhuru Kenyatta's case, which has since been dropped.

“I am surprised to hear people say we have done nothing about the case. We applied to be enjoined in the case as amicus curiae (friend of court) but the application was turned down. We will continue to engage the court because that is our responsibility as a state party, ” Githu told The Nation in an exclusive interview.

Mr Ruto's case has sparked political tension in the Jubillee Coalition with legislators affiliated to the DP's United Republican Party (URP) accusing the government of taking a backseat on the case against him.

He further weighed in on the decision by the ICC to allow the prosecution use previously recanted statements by witnesses who had withdrawn, as evidence incriminating the Deputy President.

The Attorney General said that the ruling was illegal, pointing out that the Hague-based court went back on agreements made in negotiations not to use the evidence.

Githu also challenged a decision by the court to have Kenya put on trial to determine whether it fully cooperated with the ICC in President Kenyatta's case.

He reiterated his earlier stand that the government had fully cooperated.

The DP's case continues to be a subject of contention, pitting URP legislators against their and TNA counterparts.
