CJ Maraga Warns Gov't Officials of Consequences for Ignoring Court Orders

Chief Justice David Maraga on Wednesday warned Government officials and Institutions of dire consequences over the failure to comply with court orders.

In a statement, the CJ noted that every Kenyan is obliged to comply with court orders and if aggrieved by the order, one should seek a legal mechanism to have it reviewed, varied or set aside.

"Failure to do so has consequences, and Judges and Magistrates are at liberty to invoke the legal avenues available to enforce those orders.

"The recent disregard of court order is an act that is not only inimical to the rule of law but is also completely at odds with Kenya's Constitutional outlook," he stated.

Nonetheless, he assured that the judiciary would continue to dispense its constitutional duty with independence and authority.

"Compliance with court orders is not an option for any individual or institution.

"We will ensure that the rule of law, justice, good governance and equality before the law are entrenched through our courts," he noted.

His remarks come at a time when the Inspector General of Police Joseph Boinnet and Directorate of Criminal Court (DCI) George Kinoti disregarded a court order requiring them to release National Resistance Movement (NRM) leader Miguna Miguna.

Last week, the Government also disregarded an order directing the Communications Authority of Kenya (CA) to restore live transmission for TV stations shut down on January 30.
